5. Conduct of Users

6. Membership Accounts

6.1. To subscribe to the service you must complete an enrolment/registration form, and pay the appropriate fee. The information you provide must be up-to-date, complete and accurate

6.2. By subscribing for membership you agree for your details to be disclosed to agents and third parties who are associated with Spain 4 You. This includes developers and estate agents who assist us with providing you with details of properties available for purchase.

6.3. Upon confirmation of your subscription a membership pack will be forwarded to you. Delivery of the membership pack shall be to your home address, as stated on the subscription form. You shall be deemed to have accepted the goods if you do not return them within 90 days of receipt.

6.4. If you decide you do not wish to proceed with the service a full refund will only be provided if you return the membership pack unused and in good condition within 90 days.

6.5. At any time after the 90 day period you may cancel your subscription by email / letter to: . After 90 days your subscription fee is non-refundable.

7. Data Protection

7.1.Information collected from Users will be held by Spain 4 You in accordance with the Data Protection Act 1998. Spain 4 You will use this information to send promotional material to you and assist with the improvement of customer services and the contents of the Site.

7.2. Personal Information may be stored and processed through other companies and agents associated with Spain 4 You to ensure you are informed of all properties which may be of interest to you. Except in relation to the above Spain 4 You will not disclose your details to any third parties without your consent.

7.3. If you do not want your personal data to be used in this way please do not subscribe to the membership.

8. Disclaimer of Warranty and Limitation of Liability

8.1. Users understand they are responsible for limiting any damages, including without limitation, direct, indirect, incidental, special, punitive, consequential, or other damages (including without limitation lost profits, lost revenues, or similar economic loss), whether in contract, tort, or otherwise, arising out of the use of this Site or any linked site.

11. Commission

11.1.If you proceed to purchase a property through Spain 4 You's developer or agency connections you will receive 60% of the commission we actually receive. This is only payable if you have not previously registered your details with the estate agency and/or developer who are connected with our service.

11.2. To be entitled to the commission you must have registered your details through our on-line enquiry form before contacting any of our associates. [This can be accessed through the web link on our home page].

12. Severability

12.2. In the event any term or condition of this agreement is prohibited by local or other law, this agreement shall be construed in such a manner as to give force and effect to every lawful provision.

13. Jurisdiction

13.1. This Agreement is governed by English Law and you submit to the non-exclusive jurisdiction of the English Courts
